HIB Hearing Process
Board of Education Hearing Request
If you disagree with the initial decision of the Harassment, Intimidation, and Bullying (HIB) case, you may request a hearing before the Board of Education (BOE).
- Timeframe to request: You must submit the request for a hearing within 60 calendar days after receiving the formal notification of the decision.
- Hearing Details:
- The hearing will be held within 10 calendar days from the date of your request.
- It will be conducted in the Executive Session of the Board of Education meeting (closed to the public for privacy and confidentiality).
- Important Notes:
- All hearings are held at the Lewis Administration Building, 45 Ranoldo Terrace, Cherry Hill, NJ 08034.
- For privacy and confidentiality, when you arrive for the hearing you will be greeted and placed in a designated location.
- The Board of Education, Superintendent, Board Solicitor, Assistant Superintendent of Business, and District Anti-Bullying Coordinator will be present during the hearing.
- Additional administrators may also be present i.e. Building Principal, Assistant Principal, Assistant Superintendent, Director of Secondary/Elementary.
- Following the hearing, the BOE will discuss the case and will not issue a final decision on the evening of the hearing.
- Your Participation:
- Parents/guardians, along with their child/ren, are allowed to attend the hearing.
- Both parents/guardians and students can present information to the BOE to help them decide whether to affirm or modify the original decision of the HIB case.
- The parents/guardians and children of both the alleged victim(s) and alleged offender(s) will be called to present at separate times to maintain privacy and confidentiality.
- Each family will be given approximately 10-15 minutes to present their information to the BOE.
Board of Education Decision
The BOE will discuss the case and will not issue a final decision on the evening of the hearing.
- BOE Decision Process:
- The BOE must issue a written decision to affirm, reject, or modify the Chief School Administrator's (CSA) decision of the HIB case.
- The decision will be made at the next BOE meeting.
- Parents/guardians will receive formal notification of the decision.
Appeal Process
The Board of Education’s decision may be appealed to the Commissioner of Education within 90 days of issuance of the board of education’s decision.
